Why is it important to have a draft plan checked?

An EHCP is a legal document and it describes a child or young person's needs, provision and outcomes to meet those needs.
​
There are 11 sections to an EHCP
​
Section A - Parents and child's views/History
Section B - SENeeds and strengths (relating to education)
Section C - Heath Needs
Section D - Social Care Needs
Section E - Outcomes
Section F - Provision
Section G - Health Provision
Section H - Social Care Provision
Section I - School/College placement (this is left blank on a draft and can only be completed when the plan in finalised. If a school/college isn't' named the placement can be named by type e.g. Mainstream/Specialist.
Section J - Personal Budget
Section K - Appendices (all documents that have been used to write the EHCP)

You have at least 15 days to read the draft plan and give your comments. Our draft plan check includes checking all the documents listed in Section K are included in the EHCP. It is quite common for LA's not to include all of the documents in the EHCP and not include vital information relating to the needs and provision.

We cross reference all of the documents to make sure relevant information is included. We make amendments to the EHCP and provide you with a written report. The EHCP should be SMART - Specific, Measurable, Achievable, Realistic, Time-bound, which means that the provision should be specified and quantified.

We can send the amended draft plan back to the LA on your behalf, if you want us to. The LA will not issue another draft, though, we do however, ask them to inform us if they agree/don't agree to the changes.

When returning the draft plan you have the right to ask for a particular school for your child/young person including any mainstream or special school. You can also ask for an Independent School or an Independent Special School.

Most LA's take your child/young person's case to a panel to decide if they require mainstream or specialist provision.
​
If they decide on mainstream, you still have the right to ask them to consult with specialist schools as your parent preference. There is no limit to the amount of schools you can ask the LA to consult with.
​
If the final plan is issued and you disagree with any of the sections of the EHCP including the school/college named, then you have the right to appeal.
